01. Definitions

The following terms, when capitalised, have the meaning given below:

  • Client: any legal entity or individual acting for professional purposes that has subscribed to A7 Emailing’s Services.
  • Platform: all the software tools and services accessible via the a7emailing.com site.
  • Content: all data, texts, images or files imported by the User onto the Platform.
  • User: any person authorised by the Client to access the Client’s account.

02. Access to the service

A7 Emailing endeavours to make the Platform accessible 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the Publisher’s control, and subject to any breakdowns and maintenance work necessary for the proper operation of the service.

Access to the Service is subject to the creation of a Client Account and payment of the subscription fees for the offers subscribed to (E-commerce, Monetisation, Architecture, Company).

03. User responsibilities

The User undertakes to use the Services in accordance with the laws and regulations in force, in particular regarding the protection of personal data (GDPR).

Security

Confidentiality of login credentials and passwords.

Content

Lawfulness of the messages sent via the platform (law on confidence in the digital economy).

04. Intellectual property

All the elements making up the A7 Emailing Platform (software, design, logos, databases) are the exclusive property of the Publisher or its partners.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, by any means or process, is prohibited without prior written authorisation.

05. Legal liability

A7 Emailing acts as a technical service provider and cannot be held liable for direct or indirect damage caused by the Client’s use of the service.

“The Publisher’s liability cannot be engaged in the event of delayed email delivery due to technical problems at ISPs or for any data loss attributable to the Client.”
